The terms for using Mote.
These terms are an agreement between you and Marc Dimacuha, doing business as Day One Labs (“we”), about the Mote app for iPhone and iPad and this website. By using Mote you agree to them. If you don’t, please don’t use it.
Your licence to use Mote
We give you a personal, non-exclusive licence to use Mote on Apple devices you own or control, as allowed by the App Store’s usage rules. Apple’s standard Licensed Application End User License Agreement also applies; where it and these terms differ, these terms apply to the extent the law and Apple allow. You may not copy, resell or reverse engineer the app except where the law allows it.
What you write is yours
Everything you create in Mote belongs to you. We don’t get any rights to it, and we never see it: it stays on your device, as the privacy policy explains. You’re responsible for what you keep in Mote and what you choose to share or export from it.
Keep your own backups
Mote has no server, so we can’t restore a library you lose. If your device is lost, broken or erased, or you delete the app, your thoughts go with it unless you have a device backup or an exported .mote file. Please keep one. Importing a .mote file replaces the library on that device.
Suggestions can be wrong
Mote suggests related thoughts, links and trail steps, some of them made with Apple Intelligence where it’s available. They’re guesses to help you think, not facts or advice, and you decide whether they’re right. Don’t rely on Mote for medical, legal, financial or safety decisions.
Price and purchases
If Mote has a price or offers purchases inside the app, they’re sold and billed by Apple through the App Store, under Apple’s terms. Refunds are handled by Apple. We’ll show the price clearly before you pay.
Changes to Mote
We may update Mote to add, change or remove features. We aim to keep your library readable across updates, and we design .mote files so later versions of Mote can open them.
No warranty
We make Mote with care, but we provide it “as is” and “as available”. To the extent the law allows, we make no promises that it will be error-free or always available, or that it will meet every need.
Limits on liability
To the extent the law allows, we aren’t liable for indirect or consequential losses, or for loss of data, arising from your use of Mote. Our total liability for any claim is limited to the amount you paid for Mote in the twelve months before the claim. Nothing in these terms limits rights you have as a consumer that the law doesn’t allow us to limit.
About Apple
These terms are between you and us, not Apple. Apple isn’t responsible for Mote or its content, has no duty to provide support for it, and is a third-party beneficiary of these terms with the right to enforce them against you. Questions, complaints and claims about Mote go to us.
Governing law
These terms are governed by the laws of the Republic of the Philippines. Any dispute goes to the courts of Metro Manila, unless the law where you live gives you the right to bring it there.
Changes to these terms
If we change these terms, we’ll update this page and its date. Using Mote after a change means you accept the new terms.
